Trade customers · Last updated: 28 September 2026
This is an English translation provided for convenience. In the event of any discrepancy, the Spanish version prevails.
1. Purpose and scope
These terms govern the sale of parts and services by Gallardo Automotive Technologies, S.L. through gallardoparts.es to trade customers: businesses, self-employed professionals and legal entities purchasing the products in the course of their business.
The customer declares that they are acting in a professional capacity. These terms do not apply to consumers, who are subject to their own legal regime. Placing an order implies acceptance of these terms in the version in force at that time.
2. Customer account
Access to prices and placing orders require a trade account. Gallardo verifies the applicant’s tax details and business activity before enabling it, and may refuse or suspend an account on reasonable grounds. The account belongs to the company that holds it and may not be transferred to third parties.
3. Catalogue, part numbers and equivalents
Each Gallardo code (GD) groups the manufacturer part numbers that are supplied with the same unit. The equivalents, applications and engine codes published are guidance to help identify the part. It is the customer’s responsibility, as a trade professional, to check that the chosen part is correct for the specific vehicle and system before ordering it and before fitting it.
Photographs and illustrations are for illustration only: they may show another part number from the same group and are not binding as to the exact appearance of the unit supplied.
4. Prices
- Prices are stated in euros and exclude VAT, as these are business-to-business sales. The applicable VAT is added to the order and the invoice.
- The applicable price is the one in the price list assigned to the customer’s account at the time the order is placed.
- Part numbers marked “PRICE ON REQUEST” have no published price: the price is given in reply to the request and is valid for the period stated in that reply.
- Gallardo may change its prices at any time, without affecting orders already confirmed.
5. Orders and formation of the contract
An order placed on the website is an offer to buy. The contract is formed when Gallardo confirms it, after checking availability, the customer’s details and, where applicable, the status of their account and credit limit. Confirmation is sent by email.
Gallardo may refuse or cancel an order in the event of an obvious pricing or catalogue error, lack of availability, outstanding unpaid amounts or suspected fraudulent use of the account.
6. Payment methods
The payment methods available to each customer are shown on the checkout page and are those agreed with them. As a general rule:
- Bank transfer before dispatch, to the account shown in the order confirmation and on the pro forma invoice.
- Payment on account for customers with approved credit, with the due date and credit limit agreed with each of them.
Late payment will accrue the late-payment interest set out in Spanish Law 3/2004 on combating late payment in commercial transactions, and will entitle Gallardo to suspend pending supplies and deliveries in progress.
7. Shipping, lead times and delivery
Shipping is included in the price on all orders delivered within Spain, including the Balearic Islands and the Canary Islands. Any lead times given are estimates and run from the order confirmation and, where payment is made in advance, from receipt of payment.
On delivery, the customer must check the packages and record any visible damage, shortage or anomaly on the carrier’s delivery note. Damage or shortages not apparent at the time of delivery must be reported to Gallardo, with photographs of the packaging and the goods, within seven calendar days of receipt, in accordance with the rules governing contracts for the carriage of goods by road.
The goods travel at Gallardo’s expense and risk until delivered to the address given by the customer, unless the customer arranges the transport themselves, in which case risk passes when the goods are made available to the carrier.
8. Core deposit
- Remanufactured and exchange parts carry a core deposit, which is the amount that guarantees the return of the equivalent used unit (the core).
- The deposit is shown as a separate line on the order and the invoice, and is subject to VAT at 21%.
- The customer has one month from the invoice date to return the core. After that period, the deposit becomes part of the price of the transaction and is not refunded, even if the unit is returned in perfect condition.
- The core must match the part number supplied or an accepted equivalent, be complete and, above all, be recoverable: that is the purpose of the deposit, for the unit to come back to be remanufactured. No refund is given for cores that have been tampered with or previously subjected to repair attempts, mistreated, knocked, or that have broken, welded, cut or replaced parts, nor for those showing overheating or burn damage, nor for those missing the connector or the accessories supplied with the unit.
- When the core is received, Gallardo identifies and inspects it. If it is accepted, the deposit is refunded by credit note, by offset against the customer’s account or by bank transfer.
- If the core is rejected, Gallardo informs the customer of the reason and provides photographs. The customer may ask for it to be returned, at their own shipping cost, within fifteen days of that notice; after that period, the unit will be handled in accordance with waste regulations.
9. Warranty
The parts supplied carry a commercial warranty of twenty-four months from the invoice date. The same period applies to new parts and to parts remanufactured by Gallardo, because our remanufacturing uses the manufacturer’s original components: a remanufactured unit has no less warranty than a new one. This applies unless the invoice itself states a different period for a specific part number or family, and without prejudice to the statutory warranty applicable to business-to-business transactions.
When repairing the customer’s own unit, the warranty covers the work carried out and the parts replaced, and its period is the one stated in the corresponding quotation and invoice.
The warranty covers manufacturing or remanufacturing defects attributable to the part. It does not cover damage resulting from incorrect fitting, contaminated fuel or tanks, failure to replace the filters, failure to bleed the system, tampering with the unit, or causes unrelated to the part itself.
The warranty is limited to repairing or replacing the defective part or, at Gallardo’s option, refunding its price. It does not include removal and refitting labour, transport of the vehicle or indirect losses arising from the vehicle being off the road.
Warranty claims require Gallardo’s prior authorisation and the unit must be sent to the laboratory for diagnosis. If the diagnosis rules out a defect attributable to the part, the diagnosis and transport costs will be borne by the customer, who will be told the amount before any work is carried out.
10. Retention of title
The goods supplied remain the property of Gallardo until their price has been paid in full, notwithstanding that risk passes on delivery.
11. Force majeure, data protection and jurisdiction
Neither party shall be liable for any failure to perform caused by force majeure. The processing of personal data is governed by the privacy policy published on this website.
These terms are governed by Spanish law. For any dispute arising from their interpretation or performance, the parties expressly submit to the Courts of Seville, Spain.
